This nationwide class action involved the improper classification of American Express financial advisors as independent contractors rather than employees. The case was filed in the United States District Court in the District of Minnesota. Angus Lawton initiated the nationwide class action by determining that a nationwide class existed. The litigation lasted over three years before it was resolved on behalf of the class for $15,000,000.00.

This case involved a client who sustained a brain injury when a piece of angle iron steel came off of overloaded tractor trailer. During the course of the litigation, ten (10) different law firms represented the various defendants in the case. Numerous motions and hearings took place, and over thirty depositions were taken in eleven states. Five experts were used in prosecuting plaintiff's case, and bankruptcies were declared by three different defendants in three different states. The case was mediated twice and resolved before trial for $4,400,000.00.
This case involved a trucking accident on Highway 526 in Charleston. Mr. McCreary was driving a work truck when he was hit in the rear by a semi. Due to the accident, Mr. McCreary had extensive medical treatment, and ultimately he had spinal fusion surgery.
Suit was filed in the case against the driver of the semi and his employers. After numerous depositions were taken, the case was resolved on confidential terms.
This matter involved a disability insurance bad faith claim. Suit was filed in Federal District Court in Charleston and eventually tried before the Honorable C. Weston Houck. After the first phase of the trifurcated trial, the case was resolved for $1,500,000.00.
This case involved a defective chemical filter press which weighed 1,800 pounds. A caster on the filter press broke while it was being serviced, resulting in a crushing injury to the client. The case was filed in the Charleston Division of United States District Court against the defendant, which was an Italian corporation. Over fifteen depositions were taken in the case prior to its resolution for $1,400,000.00.
This action involved a man whose arm was crushed by a textile warper machine. Suit was filed and brought against the company that put machine into use without installation of a safety device. Prior to trial, the case settled for a confidential amount.
In this case, the client received a substantial electric shock due to an improperly wired coffee maker. A lawsuit was filed in Charleston County against Royal Cup, a nationwide Company. The main issues involved the wiring and service of an industrial coffee machine that had been installed in a restaurant. The case was resolved at mediation for $810,000.00.
This case involved a motorized treadmill which was put into use at a retirement community. The client suffered a shattered kneecap when the treadmill started unexpectedly. Suit was filed in Charleston County, and the summary jury trial resulted in a verdict of $799,517.45.
Nursing home neglect case involving the removal of a PEG feeding tube, improper reinsertion of a PEG feeding tube, and failure to monitor the patient. The case also involved issues of neglect such as failure to properly feed the patient and monitor her vital body functions. Suit was filed in Berkeley County and settled at mediation for a confidential amount.
This medical malpractice action involved osteomylitis, which is a bone infection. The infection set in after an open reduction and fixation of a leg fracture. The client underwent hyperbaric oxygen treatment to control the infection, and experienced multiple problems. After litigation was commenced, the case was resolved for $500,000.00.
Medical malpractice case involving a breast reduction surgery. The surgery was negligently performed, resulting in asymmetrical breasts. Suit was filed in Charleston County, and ultimately settled for $200,000.00.
This medical malpractice case involved a laparoscopic gastric bypass operation. During the surgery, the operating physician nicked the client's intestine, filling client's peritoneal cavity with bile and blood. Client died four days after surgery due to peritonitis, which is an infection in the peritoneal cavity. Suit was filed in Charleston County, and settled for $450,000.00 prior to trial.
Wrongful death case involving client who had his jaw wired shut after an accident. The claim involved the hospital's failure to monitor the patient, failure to provide wire cutters at his bedside, and ultimately, the patient's death. The case settled prior to suit for $550,000.00.
This matter involved a missed diagnosis of pneumonia and sepsis which lead to the death of a 35 year old man. Two cases were filed; one for the benefit of the decedent's children and the other for the benefit of the decedent's mother.
The litigation lasted over 2 years. During discovery 26 depositions were taken in 6 different states, and 4 different defense firms represented the defendants. The Lawton Law Firm hired 6 experts to testify and used 4 focus groups as part of the trial preparation. Significant offers were rejected before trial, and the matter went to trial in November of 2009. After 4 days of trial, the cases settled for a combined total of $1,400,000.00.
This case involved a fall at a hospital. The client had multiple surgeries after the accident. A lawsuit was filed against Servicemaster, which is a nationwide corporation which provides janitorial services to hospitals and other executive offices. Servicemaster's national counsel defended the case. The matter was settled at mediation for $390,000.00.
This premises liability case involved the improper use of chemicals and signage, resulting in injuries that required surgery. The lawsuit was filed in Charleston County Court of Common Pleas, and settled for $330,000.00.
Premises liability case involving back surgery. The case was arbitrated, resulting in a verdict of $350,000.00.
This case involved a railroad crossing accident in Georgetown County. The client was driving a dump truck that was loaded with steel, when the truck was hit by a CSX train. The case filed in Georgetown County, and settled prior to trial for $277,000.00.
Motorcycle accident which resulted in an open fracture to client's leg with multiple injuries. Client was hospitalized, underwent several surgeries, and ultimately required leg amputation. During negotiations, the claim settled for $2,000,000.00.
Motorcycle accident case involving fatality. The case was subject to a cap on damages due to the South Carolina Charitable Immunity Statute. After suit was filed, the case was mediated and settled for $322,000.00.
